dc.description.abstract | Lord Kenyon described statutes of limitation as "Statutes of repose" (vide per Dallas, C. J. in Tolson v. Kaye (1)) and Bramwell, B. as "Statutes of peace" (Hunter v. Oibbons (2)). In the case of Baker (1890)44 Ch.D .262, Cotton, L. J. observed that pleas of limitation would never be looked upon with any favour since they are used to defeat the debts clearly due. The purpose and effect of statutes of Limitation is to protect defendants. | - |
