An Analysis of the Impacts on Anti Circumvention Laws in India

Abstract

Copyright is included in the class of rights referred to as intellectual property rights. Property rights granted for creative works of human mind are implied by intellectual property. Therefore, copyright law contributes significantly to the promotion of intellectual innovation by protecting some creative works of human intelligence. For the benefit of the general public, copyright legislation exists primarily to encourage the production and sharing of intellectual works. Copyright law is governed by the idea of quid pro quo, which means give and take. A creative work is presented to the community by an author who has temporary exclusive rights to it before it becomes part of the public domain. The moral argument for copyright law is that creators should have the right to control works that are essential to their individuality, while the economic argument is that copyright laws encourage authors to create new works by guaranteeing exclusive rights for commercial exploitation. A country's intellectual wealth increases with the level of protection because it gives authors more incentive to produce. Technological advances in printing techniques resulted in increased commercial exploitation of works resulting in the passage of laws protecting copyright.
